This depends on where you are.

Where I live they never test for this so no leagle action will be taken.

In some places you can not register or operate a car that does not conform to the specification.

In some places random roadside testing is done and the car is banned from operation or impounded until repaired. Rumour has it that many Germans each year surrender old cars durring this testing rather than repair them.
