"Freedom of religion" in India is a "fundamental right' that is guaranteed by "Article 25-28" of the Indian Constitution
Explanation:
- India is a nation to people following diverse religions and having diverse faiths. There are major religions in India which are Jainism, Hinduism, Buddhism, Islam, Christianity, & Sikhism, .
- Therefore it's important to defend and preserve the interests of each faith and growing culture of such a large society, adopting various faiths and beliefs. In India, however, the freedom to religious worship (such as the temple, mosque and the church) is guaranteed, but is limited to some provisions as laid down by the Constitution.
- "Article 25" guarantees freedom of conscience & free practice, profession, & religion propagation-
- "Article 26 "guarantees" the following rights to a "religious denomination" with subject to morality, health, & public order:
- To "establish & maintain" institutions for charitable & religious purposes.
- To manage its "own affairs" in religion matters.
- To acquire, own, & administer both "immovable & movable" property according to law.
- "Article 27" provides freedom from the "payment of taxes" for promotion of any specific religion. No person can be forced to pay any kind of taxes, the "proceeds" of that particularly appropriated in "expense payment" for the maintenance & promotion of any specific "religion/religions denomination".
- Article 28 guarantees the freedom as to attendance at religious worship or religious instruction in "specific educational institutions".
- Under the Constitution, only a "secular state" can accomplish its the above objectives and insure that this is accomplished. A secular State neither imposes any single faith nor violates the individual's religious rights. The Indian state tries to combat this supremacy in different forms.
- India has also implemented a policy to separate the influence of religion and control of the State, in keeping with this principle of religious equality for everyone. Secularism is a "separation of religion" from the state .
- The state "distances itself" from the religion & does not obey that ideology by a particular community. "Equal respect" is given to all religions The state will intervene with religion only to avoid dominance by a religious culture.
- States interferes only to make sure all religions and religious practices are give equally respect and are treated with equality. However, state can "intervene" in the religion on the basis of the communities' personal laws to make sure the laws associated with "equal inheritance" are safeguarded.
