He/she should be told the reason for arresting
If simply arrested they can seek justice
The police can put the FIR on the arrested person

Aside from the arrangements of CrPC, Article 22(1) of Constitution of India gives:
"No individual who is captured will be kept in guardianship without being educated, when might be, of the grounds of such capture nor will he be denied the privilege to counsel, and to be shielded by, a legitimate specialist of his decision."
