Jurisdiction is the power that the court of law exercises to carry out judgments and enforce laws!

Original Jurisdiction means the power to hear and determine the cases at first instance of hearing, i.e. those cases which cannot be moved to any other court other than the Supreme Court!


Supreme Court exercises original jurisdiction in the following cases 

1. Center-State or Inter-states disputes
    *between government of India vs one or more states
    *between government of India and any state vs one or more states
    *between two or more states

2. Protection of Fundamental rights - The court can issue several writs for the enforcement of fundamental rights

3. Transfer of cases from Lower court - Supreme court may transfer to itself cases from one or more High Courts or may transfer cases from one High Court to another.

4. Interpellation of Constitution - The Supreme court has the power of original jurisdiction in regard to questions as to Constitutional validity of central laws

The Supreme Court has the power to take cases directly in matters between the Government of state or the Centre .

It has original jurisdiction in Fundamental rights and matters relating to Constitution.

Supreme Court has original jurisdiction in the following :

  • Interpretation of the Constitution
  • Protection of Fundamental Rights
