Advantages:-
J&K was merged into India on the assurance to the people & ruler of J&K that there sovereignty (vestige) will be respected & safeguarded at any cost. Here, it is needed to be mentioned that Art. 370 is one such (& very strong guarantee) of sovereignty.
Article 370 was incorporated by the presidential order at that time. Hence, continuing with article 370 will ensure the credibility of highest office of the country.
Article 370, in a time, when there seems to be a lack of trust between the state & the centre may be acting as a (constrained) bridge in between of them. Hence, this good sense should be left to prevail.
Article 370 was recommended by the constituent assembly of the J&K. Upholding this will demonstrate that centre really holds great respect for the great souls of Kashmir.
Further, Article 370 may be interpreted as the assurance of govt. of India to another party. Hence, it would gain much weight in the way that word and assurance of the government of India must be having ever-lasting longevity. This will help in uplifting the image of Indian govt. in international forums
Disadvantages:-
Above everything, state’s unity, integrity & sovereignty is preponderant. For the integrity of this country, it is needed to have a united country in terms of administration. Hence, this article may be regarded as in juxtaposition of the notion of unity & integrity of this great nation.
Article 370 was inducted by Presidential order. Now it is the time to restitute the parliamentary supremacy by having a detailed debate on this & taking future course of action through that.
When, even the constitution of J&K says that it is and will remain integral part of India, this provision, itself becomes obsolete and implores getting jettisoned.
The epoch when this article was introduced has lost its sheen. Now Kashmir no longer remains alien to the rest of the country. Hence this schismatic provision needs no longer be countenanced.
Article 370, many-a-times is looked as the stumbling block in the pathway of centre’s outreach to the state and its beautiful people. Getting away with this would proffer direct contact channel between centre and the state, rendering greater congregation of Kashmiris into rest of the country.
