As per Section 2(h) of Indian Contact Act,1872 . An agreement which is enforceable by law is a contract. An agreement to be a contract must include some essentials. The essentials of a valid contact are

1. Two parties

2. Capacity to contract

3. Intention to create legal relationship

4. Performance of the contract

5. Certainty of meaning

As given under Section 10, The agreement to be a contract must be made by free content of parties competent to contact for lawful consideration with a lawful object, and are not expressly declared void.

Agreement is a wide ranging term which encompasses a social agreement, a domestic agreement & a legal agreement but contracts are only legal.

In the above case, the agreement made between Ramamurthy & Alisa is a social agreement & not legal. An agreement is enforceable by law only when there is legal relationship between the parties. Here ass Ramamurthy contended, there is no contract.

After analysing the given situation in reference of applicable provisions of the act we can conclude that Ramamurthy's contention was right & Alisa cannot claim any compensation from Ramamurthy as there was no contract between them.
