The issue has remained a subject of conflict for almost 35 years, with several bilateral agreements and rounds of talks failing to produce results.

However, a comprehensive bilateral treaty was signed by Indian Prime Minister H. D. Deve Gowda and Bangladeshi Prime Minister Sheikh Hasina Wajed on 12 December 1996 in the Indian capital of New Delhi. Farakka barrage was built in 1974 by India on river Ganga to save the port of Calcutta, but Bangladesh made an objection on the ground that there should be an uninterrupted flow of waters around the year.

An agreement was concluded between the two States for sharing of the Ganga water on September 30, 1977 for a period of 5 years.

After the expiry of the agreement, the agreement was renewed on year to year basis until 1988 after which any bilateral deal between the two governments was ruled out due to the strained relations.

However, a Treaty for the sharing of waters was concluded by the Two States on December 12, 1996 for a period of 30 years.

The two countries decided to set up a joint committee of representatives nominated by the two governments for the implementation of the Treaty, and examining any difficulty in its implementation.

The Treaty Lays down that any difference of dispute, if not resolved by the joint committee will be referred to the Indo-Bangladesh joint rivers Water Commission.
