I’m not sure why it would be handled any differently than any other type of criminal case.

If there is a jury, the jury will act as the finder of fact.

That means the jury will determine which facts are true after considering the evidence.

If the judge acts as the trier of fact, he or she will make determinations as to what is true.

The prosecution has the burden of proof and must prove each element of theft beyond a reasonable doubt.

The defense may request that the case be dismissed after the prosecution has presented their case for failing to prove any or all of the elements.

If the motion to dismiss is denied, the defense can put present their case.

The judge will make rulings on objections and decide what evidence is admissible... ☺ ☺
