The puzzle seems very easy at first. But in my opinion, its not someone who is not in the room. There are decent clues you can use to find the killer.

The knife is not a good criterion as one suspect has access to a lot of knives, the waiter. Also knives given in restaurants are not very point.

The next thing people thought of was that it being a ladies washroom, only #3, the lady with the empty plate could have done it. But I think she had just arrived and was waiting for somebody to take her order, that would be the waiter (with the glass of wine).
