Prakahar purchased an ISI mark electric iron from Bharat Electricals. While using it, he found

that it was not working properly. He approached the seller and complained about the same. The

manufacturer refused to replace and Bharat Electrical decided to file a complaint in the consumer

court. Can Bharat Electricals do this? Why? Also explain who is a consumer as per Consumer

Protection Act, 1986.

Yes, Bharat Electronics can do it because, from Prakahar's point of view, Bharat Electronics is liable. And from Bharat Electronic's point of view, the manufacturer is liable/to be held accountable.

As per the various rights and reliefs available to a consumer, a consumer has every right to seek redressal in case a product/service falls short of his expectations/causes harm. As per the various reliefs available, they can get a new one, one without defects, or be paid compensation for any kind of damage that was caused.

A consumer is anyone who consumes a product or receives some kind of service. It excludes all those people who buy a product or service for the purpose of resale. In other words, a consumer is someone who is the end-user of the product/service he purchases.
