layers of fossils get deeper and deeper with passing time. that's why we find the dinosaurs fossil deeper in soil as they died a long time ago. similarly the fossils of organisms which are recently died would be found in upper layers of soil.Hence we can say that recent fossils are found closer to the earth surface.
