The election  commission is mandated under Article 61 
It ensures that regular, fair and free elections and referendum are held.

It organize, conduct and supervise elections and referendum in accordance with the constitution.
It demarcates constituencies in accordance with the constitution.
It formulates and implement voter's register's.
It hear and determines elections complaints arising before and during polling, and ascertain, publish and declare in writing under it's seal the result of the elections and referendum.

Functions of Election Commission in ensuring free and fair elections -

1) The superintendence, direction and control of elections.

2) To advice the President or Governor of a state for disqualification of any member.

3) To pass any order in respect of the conduct of the elections when there is no law or rule made under the law.

4) To conduct elections of various bodies.

Role of Election Commission in ensuring free and fair elections -

1) The Election Commission is regarded as the guardian of free and fair elections.

2) The Election Commission issues a Model Code of Conduct for political parties and candidates to conduct elections in free and fair manner.

3) To get rid of the growing influences and vulgar show of money during elections the Election Commission has fixed the legal limits on the amount of money which a candidate can spend during the election campaigns.

4) To prevent electoral fraud, Electoral Photo Identity Cards were issued in 1993 by the Election Commission. In 2004 elections, it was mandatory to posses these cards.
