Role of courts in the implementation of consumer rights.
- The Consumer Protection Act, 1986 aims to protect and promote the rights and interests of consumers. The Act provides safeguards against "defective goods, deficient services, unfair trade practices," and other such exploitation.
- This Act provides for the setting up of three-tier machinery for resolving issues faced by consumers. The machinery consists of District Forums, State Commissions and the National Commission. It also gives for the arrangement of consumer protection councils in every District and State.
- If the consumer court is satisfied with the genuineness of the complaint, it can issue one or more of the following directions to the party against which the complaint is filed:
1. To issue corrective advertisement to neutralise the effect of a misleading advertisement.
2. To pay adequate costs to the appropriate party.
3. To remove the defect in goods or deficiency in service.
4. To replace the defective product with a new one.
5. To refund the price paid for the product, or the charges paid for the service.
6. To pay a reasonable amount of compensation for any loss or injury suffered by the consumer.
7. To discontinue the practice and not repeat it in the future.
8. To withdraw the hazardous goods from sale.
9. To stop the manufacture of dangerous goods and the offering of hazardous services.
10. To pay an amount to be credited to the Consumer Welfare Fund.
