  • The "National/Central/Federal Government shall enact and develop regulations to protect "human health & the environment". National governments have a great deal of accountability in their jurisdictions for effective "broad environmental policy & action".
  • The Ministry of Environment is usually responsible for establishing policies within a national framework & for converting such directives into a provincial framework, the provinces or state / local government or municipalities are responsible.
  • The municipalities have the authority & financial capacity to establish and enforce "local area & environmental policies". The requisite checks & balances can be ensured through close cooperation between all govt levels within the system..

Provincial/State Govt

  • Although the Ministry is responsible for national environmental policies, the provincial/state government is in charge of implementing this policy/guidance into a regional/state/provincial context. The  provincial govts devise regional policies &  draft "regional plans" & "develop guidelines" on the zoning for "location & expansion" of residential,  commercial, industrial  areas into cities, towns & villages.
  • Environmental protection and management strategies & policies is associated with spatial planning and establishing a clean environment of clean air , water and soil, through the regulation of transport, industrial and other pollution sources. To this effect, provincial authorities shall issue environmental licenses, for instance, caps on pollution and noise interference.
  • The provinces are also responsible for the implementation  of environmental legislation by large corporations within the stat. For example, in promoting the use of clean energy and achieving green energy output goals such as wind power, the regional authorities play a vital role in providing sufficient room for construction of wind farms.

Local Govts/Municipal Govt

  • The implementation of regional environmental policy policies and plans for local bodies is largely decentralised. Such authorities  draft municipal legislation and are prepared to "implement & enforce" decisions & laws through legal as well as financial means.
  • Municipalities/local govts also cooperate on environmental issues at the local level, for example, the quality of water & waste water disposal with municipal bodies such as water boards. They are in charge of preparing regulations, so as to enforce the  national environmental laws, policies, guidelines and acts and other environmental regulations to implement and enforce the regulations. The national environmental policies cover issues such as separate waste collection, toxic waste disposal,  noise nuisance, air quality, &  environmental permits for commercial & industrial activities.
  • Environmental regulations may differ from municipality/local govt to municipality/local, such as on the separated recycling & disposal of waste from households & on industrial and commercial activity.
