Our constitutional fathers have adopted the rule of law from England and some clauses have been introduced into the Indian Constitution. Indian Constitution is considered to be supreme and no one is above Indian Constitution.
Explanation:
- The principle of the Rule of Law is that, not the ruler or the representatives of the people however the law governs the state. The Indian Constitution aims to make India be governed by a rule of law. The Constitution shall be the supreme authority in the nation, & the constitution shall confer authority to the legislature and the executive.
- While the law supremacy principle sets in place check & balances over the govt on making & overseeing the law, the equality before law principle aims to guarantee that the law is implemented & enforced in a fair manner. Fair legislation is not enough, but the statute must still be enforced in a fair way.The law cannot discriminate between people in matters of sex, religion, race etc
- If certain rights are breached, the Supreme Court or the High Court can be addressed in compliance with Article 32 and Article 226 of the Indian Constitution. The Indian Constitution is enriched with laws, i.e. justice, dignity and democracy. Any laws enacted by the Central Government or State Government shall conform with the Indian Constitution. If any statute made by a legislature in violation of the Constitution, the statute is considered null and void.
