Shweta lost her vision of one eye due to doctors negligence. explain the act under wch she can lodge a complaint against the doctor.

She can file her complaint against the doctor under COPRA(consumer protection act). She has been empowered with right to safety under this act. While using good and services, as consumers, we have the right to be protected against the marketing of goods and
delivery of services which are hazardous to life. Producers need to strictly follow the required safeguard rules and regulations .

Section 304A of the Indian Penal Code of 1860 states that whoever causes the death of a person by a rash or negligent act not amounting to culpable homicide shall be punished with imprisonment for a term of two years, or with a fine, or with both.

For civil malpractice/negligence where you are seeking damages in monetary terms, you will have to approach consumer forum under the COPRA which should ideally provide a judgement in under 3 months.
You can argue for yourself but having a lawyer arguing for you may provide you a better chance of winning the case.

Now in case of Shweta she can file a complain in COPRA against that doctor she can also take help from other doctor for this purpose.
