For the purposes of these Terms, “you” means the student who accesses or uses the Brainly Services or Brainly Subscription as well as the parent or guardian who accesses or uses the Brainly Services or Brainly Subscription with the student or pays for a Brainly Subscription. If you are a parent, guardian, or other person who enables a student to access or use the Brainly Services or Brainly Subscription or to purchase a Brainly Subscription, you agree to stand in the shoes of such student for the purposes of making us whole in case of claims, damages or indemnifications that we might properly assert against a student, if not for his or her age.

THESE TERMS REQUIRE THE USE OF BINDING ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE ALL DISPUTES ARISING UNDER THEM, RATHER THAN JURY TRIALS OR CLASS ACTIONS.
