Hot and concentrated nitric acid is a powerful oxidising agent. It can oxidise sulphur to sulphuric acid. So, the sulphur is oxidised from an oxidation state.Now, consider the reduction half-reaction of nitric acid decomposing to nitrogen dioxide.
