Because what's underneath it is not stable or permanent. Magma below the crust still retains most of the heat left over from the formation of the earth. It is semi-fluid rock, constantly flowing in hot convection currents that rise and fall like that stuff in a lava lamp

The earth's crust already is hard and brittle. That is why, when the tectonic plates which are part of the crust, move, there are earthquakes. It is made up of igneous , metamorphic , and sedimentary rocks . Below the brittle upper crust is a transition zone called the brittle-ductile zone.
