The earth's surface is not the warmest when the sun is at the highest position in the sky (period of maximum daily insolation), the surface is warmest in the late afternoon, generally just 3 to 4 hours before the sun sets.

By warming up, it regains its ability to evaporate, and lose energy as fast as it is arriving from the Sun, so it can stay at a stable temperature.

The surface of the Earth is heated by incoming shortwave radiation from the sun. This radiation heats the Earth which in turn releases long wave radiation which warms the atmosphere and is what is reflected by the Greenhouse effect.
