"Emergency" in India refers to a period of 21 months from 1975 to 1977 during which the then Prime Minister Ms. Indira Gandhi had an emergency state proclaimed in the nation. The emergency, officially issued in compliance with Article 352 of the Constitution, as a result of the prevalent "internal disruption."  allowed the Prime Minister to govern by decree, to postpone elections & to curtail civil liberties.  Several other violations of human rights have been registered, including a mass sterilisation drive led by the Prime Minister 's son Sanjay Gandhi. Emergency is one of the most contentious moments in the history of India.

  • The govt carried out large-scale detentions. Even under the Habeas Corpus petition detained political people could not appeal against their detention. While several petitions were made, the govt stated that it was not appropriate for detained people to be informed for reasons. Eventually, in April 1976 it was seen that by over-ruling the high courts "under" supreme court, the govt could take away "citizens' right to life & freedom", and accept government's plea.
  • The Parliament brought several new constitutional amendments and rendered an amendment saying that it would not be possible to contest the elections of the "Prime Minister", "President" & "Vice-President" in the courts. ,The 42nd amendment was later introduced to bring about a number of constitutional changes, such as during the legislative the elections could be postponed 
  • Press censorship existed, which forbid press freedom and the publishing of newspapers until any content was approved by the govt   . There were also prohibited strikes, marches, & public upheaval. Various fundamental liberties, including the right to restore "fundamental rights" to court, had since been revoked.
