Answer:

The ICC may choose not to investigate a case that is not true.

Explanation:

Composition and Duties of the Internal Complaints Committee:

  • The assumption that women would become autonomous and self-assured and could protect themselves in any situation resulting from this empowerment of women.
  • However, the grim reality is that, at least once in their careers, more than 50% of working women experience workplace harassment in the form of sexual harassment, vulgar statements, unwanted gestures, or gender discrimination.
  • The majority of working-class women do not report sexual harassment, either because they are ignorant of their rights or frequently because of concern about being socially stigmatized or losing their jobs.
  • The government's action was required to help create a safe workplace for women due to the rising number of sexual harassment cases involving working women in all industries in India.
  • Thus, the Sexual Harassment of Women at Workplace Act of 2013 (hereafter referred to as the "POSH Act") was created.
  • India's first codified law, the POSH Act 2013, was created with three main goals in mind:
  1. prevention
  2. prohibition
  3. redressal

The complaint's timeline:

1) File a complaint within three months of the alleged incident.

2) Within 7 days after getting a copy of the complaint, notify the respondent.

3) Within 90 days of the inquiry's conclusion

4) Report Submission: within 10 days of the investigation's conclusion

5) Recommendations must be put into action within 60 days.

6) Within 90 days of the recommendations, file an appeal.

  • the following receipt of a written request, the Internal Complaints Committee may suggest the following courses of action to the employer throughout the ongoing investigation:
  1. Transfer either the resentful party or the respondent to another place of employment.
  2. Give the ladies who are complaining a three-month leave of absence.
  3. any additional relief that may be recommended.

Hence, ICC may not have a right not to investigate a case, this is a violation of the main purpose of this ACT.
