Supreme court has write jurisdiction under article 32 of constitution to protect the fundamental rights of citizens Of India. Through various courts Supreme Court can declare a law enacted by legislation as null and void in case such law is in violation of fundamental rights of people.

The court is the forum in which questions of law are answered. Fundamental Rights are primarily and almost exclusively, questions of law. What is seen as a fundamental right by some is seen as an option by others, and these opposing views have to be worked out somewhere.

That somewhere has to be the courtroom because, in the ordinary scheme of things, there is no other space where the arguments can be heard and a decision made on the issues.
