Ausable was a clever man because he made up a story of there existing a balcony under their room where they both stood in the heated encounter.

Max had the gun pointed at Ausable when he heard a knock on the door. Fearing that it might be the police outside, Max made his way towards the balcony. He jumped out of the rooms' window onto the balcony on the lower ground, which basically never existed. This led to Max falling to his death, voluntarily.
