That’s because that isn’t what makes an amphibian an amphibian. To be an amphibian, it has to follow these rules:
It must go through metamorphosis, meaning it starts in water and lives out the majority of the rest of its life on water. Unlike the tortoise here.
It must have no scales(which the tortoise does)
It must absorb water and air through it’s skin(which the tortoise doesn’t)
Just because an animal lives on both land and water does not mean it’s an amphibian. Take hippos, for example. In fact, tortoises don’t even live in the water!
