As per Section 97 of Criminal Procedure Code,1973,The District Magistrate ,Sub Divisional Magistrate or Judicial Magistrate of First class can issue a search warrant if he has reason to believe that:
Any person is confined wrongfully.
And that confinement amounts to offence.
then he can issue a search warrant directing any person either a police officer or anyone else. Search should be conducted in accordance to the procedure laid down in law.
And if the person who was wrongfully confined is found shall be taken before the Magistrate.
