we all know that India is a democratic and a federal country but still some special powers are given to some states like you can see in Jammu Kashmir. so why is there so inequality

So to get the answer to this question, we will go back to what happened when constitution was being formulated:

(Before starting you should know that Article 370 of the Indian constitution gave special status to J&K from 1954 to 31 October 2019. Refer to the attachment. Blue = India, Green = Pakistan, Yellow = China. J&K is jointly administered by above stated countries. I've lived in J&K in around 2013 and you won't believe that it was very unsafe to live there. You were not even allowed to go out of the army camp. Every few days, there were bombardings.)

So in short there were two reasons:

  • Firstly, there was a fight been India and Pakistan for J&K. The fight was to include J&K into their territory. As you know, it's still going on. And UN stated to solve this through a fair and impartial vote.
  • Secondly, if India would give special powers to the state, the people will be happy and decide to be a part of India.

Now in detail,

  • On 15 Aug 1947, India and Pakistan were granted independence from the British rule. And then they could exist as independent nations. The State of J&K chose to neither join India nor Pakistan. It decided to exist independently.
  • But on 20 October 1947, Pakistan army attacked the state and marched towards Srinagar gathering local support as at that time 75% of the population was Muslims.
  • The ruler of J&K at that time, Maharaja Hari Singh, approached India for help. India dispatched its troops to stop Pakistan army. With the condition that the state of J&K would join India.
  • Hence, an ‘Instrument of Accession’ was signed between the Indian PM, Nehru and Maharaja Hari Singh on 26 October 1947.
  • Pakistan disputed the legality of Instrument of Accession, which lead to the first Indo-Pak conflict in 1948. A ceasefire(temporary suspension to a fight) was announced on 01 January 1949 and India took the issue to the UN Security Council for resolution.
  • The UN Resolution of 05 January 1949 stated that the decision regarding accession to India or Pakistan was to be decided through a fair and impartial plebiscite, conducted after the area was demilitarised. But the plebiscite was never held.
  • On 17 October 1949, Indian Constituent Assembly adopted Article 370 of the Constitution ensuring special status and internal autonomy to Jammu and Kashmir. It clearly states that the provisions of this Article with respect to the State of J&K are only ‘temporary’ and not permanent.

So we can't say it was exactly an inequality. And India is still a democratic and federal country.
