The constitution of India has ensured that the commission shall act as an independent body. Independence is secured by some of these provisions:


1)The chief election commissioner shall not be removed from office except in like manner and on like grounds as a judge of the Supreme Court. A judge of supreme court can be removed only by an order of the President passed after an address by each House of Parliament supported by a majority of the total membership of that House and by a majority of not less than two-thirds of the members of that House present and voting has been presented to the President in the same session for such removal on the ground of proved misbehavior or incapacity.

2)The other election commissioners cannot be removed from office without recommendation of the CEC.

3)Their conditions of service shall not be varied to their disadvantage after their appointment.

4)It is the duty of the president or the governor of a state to make available to the commission , when so requested, such staff as may be necessary for the conduct of its functions.
