1 After the counting has been completed in all aspects, you have to proceed to make the formal declaration of result of election.
1.2 Before proceeding to do so, you must, however, verify and satisfy yourself that there is no case of any kind which requires to be referred to the Election Commission for its directions and that there is no general or special direction from the Commission or from the Observer to withhold the declaration of result in your constituency.
1.3 According to the existing directions of the Commission, after the counting of votes is complete in all respects, you may declare the result of counting of votes under section 66 of the Representation of the People Act., 1951, EXCEPT in following cases:
(i) The margin of votes secured by first two leading candidates is less then 1% of the total valid votes polled by all candidates;
(ii) You have set aside any ballot box before counting of votes which have been found tampered with in any manner;
(iii) There are complaints from candidates or their agents about any tampering with the seals of ballot boxes;
(iv) There is a request for recounting which has been rejected;
(v) Any unusual features found during the counting of votes leading to suspicion of irregularities.
1.4 In any of the above cases you should send a report to the Commission and shall not declare the result of election without the specific written clearance from the Commission. The report for obtaining clearance for declaration of result, should be submitted in the prescribed proforma (Annexure XLVII). At the time of seeking permission for declaration of results, you should supply the following information to the commission:
