The separation of powers is a fundamental guarantee of the independence of the judiciary. In the decision-making process, judgesshould have freedom to decide cases impartially, in accordance with their interpretation of the law and the facts. They should be able to act without any restriction or improper influence.

Independent of judiciary means that it is not under the control of the legislature or the executive.

The judges donot act on the direction of the government or accordingto the wishes of the party in power.

This is why all modern democracies have courts that are independent of the legislature and the executive.
