In a country like India, all citizens are equal before the eyes of the law and this is enshrined in our constitution. Article 21 of the Indian Constitution guarantees free and fair trial to its citizens. Just as law should take its own course and should not be influenced, it is the duty of the Indian state to ensure that the guilty are brought to book. Simultaneously, however, the accused is not guilty until proven to be so. In fact, the state is supposed to provide free legal help to an accused if the situation so warrants; a case in point is the defense of Pakistani terrorist, Ajmal Kasab, by a Government provided advocate in the Mumbai Blasts case. All this together implies a fair trial.
