What do you understand by the term 'rule of law'? How does the constitution of india seek to establish it?

Rule of Law essentially means rule by law but with the inception of the modern democracies, the most acceptable view of the principle was expounded by A.V. Dicey the (British Jurist). According to him, Rule of Law means:


Absence of Arbitrary power: This ensures that no man is above law and no man will be punished except by the court for the breach of law.

Equality before Law: This ensures no man is above law, irrespective of rank, position, caste, class, creed, sex etc.

Individual liberty: This is ensures rights of private individuals.

With respect to the Indian context,


Absence of Arbitrary power is established by the Constitution as the supreme law along with the various Public and Private Laws like Administrative law, Indian Penal Code etc.

Equality before law is again established by the Constitution under Article 14–18, especially under , which establishes “Equality before Law”

Individual Liberties are also protected under part on of Constitution of India, especially under Fundamental Right to Free Speech and Right to Life.
