A bill of law after passing from both the houses of the parliament, it is sent to the President. If the President found that the bill is against the Constitution, he sends it back to the Parliament with his recommendations. Now if the Parliament wants to pass the bill unchanged, it has to amend the Constitution under article 368 of the Constitution of India. Then the President gives his assent to the bill.
But if the bill or law passed through constitutional amendment changes the basic structure of the Constitution, then the Constitutional bench of Supreme Court would quash this law and the law is declared null and void.
The same procedure is followed in State Legislature, where governor has the same role as President.
