Answer:According to 52nd Amendment Act of 1985 or popularly called as the anti-defection law provided for the disqualification of the MP or MLA on the ground of defection.
Disqualification:
Member of political parties: becomes disqualified (A) if he voluntarily gives up the membership (B) if he votes or abstains contrary to any direction issued by the whip of the political party without obtaining prior permission from the party and not the party not condoning the actin within 15 days.
Independent members: becomes disqualified if he joins any political party after such election
Nominated members: if he joins any political party within 6 months of taking seat in the house.
Exception:
If a member goes of the party as a result of merger of the party with another party. A merger happens when 2/3 rd of the members of the party have agreed on the merger.
If a member after being elected as the presiding officer of the house, gives up the membership of the party or joins it after he ceases to hold that office in order to maintain the dignity and impartiality of this office
