☜☆☞ The old Consumer Protection regime amongst other problems had one major problem – implementation of the provisions, the final relief for consumers getting lost in the procedural framework.
A superficial overview of the backlog of cases with the National Consumer Dispute Resolution Redressal Commission (NCDRC) shows original complaints pending from 2008-09. On an average a consumer case could take up to 4-5 years to get resolved.
Now the CCPA has been mandated to take suo moto action, investigate accordingly. The authority has powers to intervene whenever necessary to protect consumers from unfair trade practices.
CCPA is a regulatory body or an executive agency which has been given the powers to investigate, and prosecute by passing final orders.
A direct complaint can be made to the CCPA and It is the mandate of the CCPA to intervene in the matter, look for any other consumers with similar grievances club the cases together to form a class action case and then pass any orders deemed fit.
☜☆☞Right to Safety - The goods or services which are hazardous to life, health and property a consumer is to be guaranteed with right to safety against such goods or services.☜☆☞Right to be Informed - All the information related to a good or service purchased must be provided to the consumer. The information includes manufacturing date, expiry, purity, ingredients etc.
☜☆☞Right to Choose - A consumer has a right to choose the goods or service he wants to avail from the market freely and no seller can influence his choice in any manner.
☜☆☞Right to Heard - A consumer has a right to complain against the faulty products or faulty servicesreceived by him. This right also allow a consumer to file a consumer complaint in the consumer court.☜☆☞Right to Seek Redressal - This right provides that a consumer can seek compensation against the unfair trade practices of seller.
☜☆☞Right to Healthy Environment - This right provides protection to consumers against environmental pollution
☜☆☞Right to Consumer Education - This right provides that consumer must be aware of the rights entitled to him and remedies available to him in case of violation of his consumer rights.
