• Defendant negligence created a condition that endangered the safety of either the defendant or other person
• Plaintiff attempts or completed a rescue of the endangered person
• Plaintiff , as a result of the rescue efforts , sustained injuries or died . The rescuer died is the rescue attempt and the action for wrongful death was brought by his survivor
