With the suspension of the non cooperation movement and the continued repressive activities of the government, a section of the Congress led by C R Das and Nehru felt that the legislatures should not be boycotted and the fight had to be conducted from within. That is, the Congress should contest elections, join the government and disrupt the working of the legislatures from within.

It was at the Gaya session of the Congress in 1922 that the entry proposal was rejected. C R Das resigned from the post of the president and along with Nehru and others, formed a new party within the Congress called Congress Khilafat Swaraj Party, briefly referred to as the Swaraj Party.
