The constitution of India provides us with certain fundamental rights that can not be taken away by the court of law.

In case the fundamental rights are taken away from the citizens, then under article 32, they can be enforced in the court of law by the citizen. Thus, this is known as the constitutional remedies.

It often leads to imprisonment or PIL. The public prosecutor fights for the rights of the citizen in case litigation is launched against them.
