The Role of Judiciary is as follow :
- Courts can take decisions on a large number of issues.
- They can take decision for punishing people for particular crimes, or about the sharing of river, waters between states.
The work that the judiciary does, can be divided into the following :
1. Dispute Resolution :
- The judicial system resolves disputes between citizens, between citizens and the government, between two state governments and between centre and state government.
2. Judicial Review :
- The judiciary has the power to strike down particular laws passed by the Parliament if these violate the basic structure of the Constitution.
3. Upholding the laws and Enforcing Fundamental Rights :
- Every citizen of India can approach the Supreme Court if they believe their Fundamental Rights have been violated.
- For example, Hakim Sheik, an agricultural labourer who fell from a running train and injured himself.
- Article 21 provides every citizen the Fundamental Right to Life which includes the Right to Health.
What is Independent Judiciary ?
- One aspect of this is the 'Separation of the power'.
- What this means is that the legislature and the executive cannot interfere in the work of the judiciary.
- The courts are not under the government and do not act on their behalf.
- It is the independence of the judiciary that allows the courts to ensure that there is no misuse of power by the legislature and the executive.
