Article 80 provides for the composition of the Rajya Sabha and lays down that it shall consist of:

(i) twelve members to be nominated by the President, consisting of persons having special knowledge or practical experience in the fields of Literature, Art, Science and Social Service; and

(ii) not more than two hundred and thirty eight representatives of the States and Union Territories.

State representatives in the Council are to be elected by the Legislative Assemblies of the state, in accordance with the method of proportional representation, while Parliament was authorized to legislate with regard to the method of election of representatives of Union Territories. The allocation of seats to each State and Union Territory is as provided in the Fourth Schedule, which provides for a total of 233 members. The total no. of present members therefore, consisting of both nominated and elected members therefore totals to 245 members.
