On 5 August 2019 the India Govt released a constitutional order over the 1954 order and on the basis of the 2/3 majority resolution passed in the two houses of India 's parliament, it made all of the Indian constitution provisions applicable to Jammu & Kashmir. On 6th August, following resolutions in both chambers of Parliament, a further order rendered inoperative all the clauses of Article 370 but for clause 1.

Explanation:

  • Article 370 of the Indian Constitution granted Jammu and Kashmir an Indian-administered territory from 1954 to 31 October 2019 on the northern side of the Indian subcontinent and  a part of the broader Kashmir region that has been subjects for conflict between India, Pakistan & China, and Article 370 has bestowed on Jammu & Kashmir the power to have separate flag, autonomy and a separate constitution  
  • In accordance with Article 35a, this article specified that the residents of the state of Jammu & Kashmir live within the context of a different set of rules, as well as  those provisions/rules/laws related to citizenship, ownership of property & fundamental rights, compared to residents of other Indian states.
  • However Article 370 was scrapped on August 2019 and on 31stOctober 2019,  the "Jammu & Kashmir Reorganisation Act 2019" was enacted by the Parliament & the state of Jammu and Kashmir was divided as 2 union territories & Union Territory of Ladakh.  On 31 October 2019, the reorganisation took effect.
