A fair trial is defined as a trial by a neutral and fair court which is conducted so as to accord each party. the due process rights required by applicable law. The right to a fair trial applies in civil and criminal proceedings along with the various rights associated with a fair trial.

Fair Trial:-

As per our Constitution and law, everyone is equal in eyes of law irrespective of their creed, religion, gender etc. So that's why, everyone is having a right to fair trial. Article 21 of the Indian Constitution guarantees the Right to life, it assures that person's freedom can be taken only after pursuing a legal process.

Conditions of a fair trial :-

  • The accused is provided a copy of FIR, chargesheet etc. based on which charges could be framed.
  • Friends and Family can be present at the trial which is held in open court.
  • Trial is always help in the presence of the accused.
  • Result is presented impartially on the basis of evidences.
