Art 13 of the Indian constitution, which gives wide powers to the court to invalidate any pre-constitution law that goes contrary to the fundamental rights and also prohibits the incumbent government to make any law that infringes upon the fundamental rights of the citizens; it being void ab initio. The function of judicial review as a ‘basic feature’ of the constitution makes it clear that the constitution views the judiciary protector of fundamental rights and also as a guardian which ensures the protection of the fundamental rights of the citizens
