In the pre-modern societies, religion was the constitution. Rulers (kings or emperors) held their reign as per the instructions of the religious scriptures. It stands true in the case of Indian history as well. But here we need to observe that, historical rulers imposed their own beliefs on their subjects irrespective of the subjects’ beliefs. There were secular rulers as well, we cannot deny that. But we cannot expect an autocrat/monarch to be benevolent in all the aspects since all the institutions of governance mechanism were vested with the ruler. Ruler’s word was the final decree in in any judgement although when there were enough judges in the rulers’ court. All the decision making power vested in one person ultimately. Trail by ordeal was in force in the criminal justice system. No separation/division and distribution of powers. Monarchy could be seen as anarchy. It was legitimate only because “might was right”. We are now seeing the countries in West Asia in the absence of a Constitution, how they are reeling under violence.
Thus overall, institution of democracy is needed to function a country well. Therefore, Constitution was framed by our Constituent Assembly that was elected by the people, indirectly though. Specific purposes why India needs Constitution are:
Constitution provides a set of basic rules that allow for minimal coordination amongst the members of the society
It specifies who has the power to make decisions in the society. It decides how the government will be constituted. It thus establishes distribution of powers and functions such that there is no single person vesting all the powers in herself/himself
It also sets some limits on what government can impose on its citizens. It is to avoid the tendencies of despotism, the balances and checks are in place at every provision in the Indian Constitution
It creates the conditions for a just society. It enables the government to fulfill the aspirations of a society
It establishes a moral identity of the people of this land
If we are able to peacefully sleep at our homes, it is because of the perfect Constitution that we have in place. Indian Constitution is an ideal work that is being replicated in any other country that is in distress. In real terms, any law made in the country is to be in accordance with the Constitutional provisions. It is a ‘living document’ as it serves the needs of not only the present generations but also of the upcoming generations.
