The recent case of Ener-G Holdings Plc v Hormell (2012) EWCA Civ 1059 has further emphasised the importance of complying with any time-bar provisions in a contractual agreement. 

In this case, the defendant had entered into a contractual agreement with the claimant dated 2ndApril 2008 which included a requirement for the claimant to notify the defendant of any breaches of warranty within 2 years of the contract date i.e. by 2nd April 2010.
