Preamble to the Constitution of India is basically the declaration of our social, economic, religious and legal aspirations.
Before the 42nd Amendment to the Constitution the Preamble began thus: “WE THE PEOPLE OF INDIA, having solemnly resolved to constitute India into a Sovereign, Democratic Republic”.
By the 42nd Amendment in the year 1976, the words “Sovereign Democratic Republic” were replaced by “Sovereign Socialistic Secular Democratic Republic”.
Preamble further declares “to secure to all citizens justice, social, economic and political, liberty of thought, expression, belief, faith and worship, equality of status and opportunity”.
The Preamble is not an active part of the Constitution in the sense that it cannot be enforced the way other Constitutional provisions can be, but on many occasions it has proved to be an invaluable help in judicial interpretation of the legal provisions.
The Preamble has been invoked to determine the purview of the fundamental rights, and directive principles of state policy. Being the declaration of the collective aspirations of the people, it also provides the broad ambit for the legislature to enact laws.
The Constitution, according to the Preamble, was adopted on November 26, 1949. The day is observed as the Law Day. The Constitution, however, came into force on January 26, 1950.
