Federalism

Federalism is a mixed or compound mode of government that combines a general government with regional governments in a single political system. Its distinctive feature, first embodied in the Constitution of the United States of 1789, is a relationship of parity between the two levels of government established.

Spirit of Federalism

The federal system has two specific objectives. They are said to be as follows: Safeguarding and promotion of the unity of the country. Accommodation and assimilation of the regional diversity of the country.

Centre-state relations

The legislative ties between the centre and state are governed by Articles 245 to 255 of Part XI of the Constitution. It sets out a double division between the Union and the states with legislative powers i.e, in territorial recognition and relation to the subject.

Both the Parliament and the State legislatures can make laws on subjects given in the Concurrent list, but the Centre has a prior and supreme claim to legislate on current subjects. In case of conflict between the law of the State and Union law on a subject in the Concurrent list, the law of the Parliament prevails.

India is a federal country. It has governments at both-central and the state levels.  

After Independence, there were only few parties which formed governments at the centre and at the state levels. When rival parties formed the Government at the state level, the Central Government tried to misuse its powers by dismissing the State Governments. This weakened the federal spirit of our constitution.

However, the condition improved after 1990 when many regional parties emerged in different states.

This also marked the beginning of the coalition government. Two or more parties formed the Government at the centre in the absence of a clear majority. This led to a new era of power sharing and respecting the independent working of the State Governments.
