If I could abolish one law, this would probably never happen in real life, it would be ASFA.

ASFA is a federal child welfare law that was singed into law by former president Bill Clinton in 1997.

The reasons are numerous as to why I would abolish this law; but it can be boiled down to these…

It imposes strict and unrealistic time limits on states in regards to reunification of children placed in foster care (15 months).

It allows states to forgo providing “services” to families in certain instances (which are unreasonable) and dictates termination of parental rights and adoption immediately after the birth of a new child regardless of the new circumstances.  

It literally emphasizes (permanency) adoption over reunification and family preservation.  

The law disproportionately (and negatively) affects Black parents and children by encouraging quick removals and adoptions and without addressing institution racism. Simply put, this law is a major contributor to the distruction of the Black family along with mass incarceration.

The law is barely effective and causes far more harm than good.
