  • Any group would require certain basic rules which are "publicly promulgated" & known to all members of  "that group" as well as enforceable to attain a "minimal degree of coordination". The constitution provides a set of basic rules which permit for this minimal coordination among members of the society.
  • The constitution stipulates the fundamental power allocation in a society. It decides who ascertains what rules are, that is, who has the right to make decisions in the society. It decides how the govt would be formed.
  • The Constitution establishes certain limits for what a govt can impose on its people. These "limits" are essential in the sense that they cannot be infringed by the govt.
  • The constitution enables the govt to fulfill the "aspirations of a  society" & create conditions for a  fair, equitable just society.
  • Last but not least, a constitution reflects & expresses a people's basic identity. This implies the people as a "collective entity" come into being by way of the basic constitution.
