Curb on child marriage

The Child Marriage Restraint Act was passed in 1929 to do away with the evil of child marriage. The main purpose of the Act was to eliminate the evil which had drastic consequences on the health and life of a female child. Getting a female child married at a an early stage of childhood can lead to the stress and strains of married life which they are not equipped to handle and in some case may even lead to early deaths of minor mothers. The law came into effect from the Ist April in 1930.

As per the section 3 of this Act any male who is above 18 years and below 21 years goes for  a child marriage shall be punished. The punishment may vary from simple imprisonment, which may be of fifteen days, or a fine of Rs 1000 and in some case both.

The Act also says that any  male above 21 years of age indulge in a child marriage would be  punished with simple imprisonment which might extend to 3 months and even attract a fine.

Section 5 of the Act says that anyone performing, conducting or directing any child marriage would be punished with simple imprisonment upto 3 months but would not attract any fine if he is able to proof that he was unaware of the fact that the marriage that took place was not a child marriage.
